There's no shortage of resources to help entrepreneurs pick themselves up after a setback, but that's where it ends. Be ready for everything that comes before it, as it is just as crucial. Closing a small business is more complicated than just turning off the lights and leaving, jk labour registration.

Taking care of all the necessary administrative tasks can be time-consuming and tedious, and it's easy to overlook something. This is the proper way to close a business, on both an emotional and a practical level.

The Fundamentals of Terminating a Business

There's a lot to do when closing down a small business, from dealing with the emotions of closing to the actual logistics. Closing a business is a complex multi-step process that can consume a lot of your time, energy, and money.

This post will teach you everything you need to know to properly close your business without incurring any unnecessary costs or legal trouble for jk labour registration. In spite of our admonition that you not try to handle everything on your own, it is important to be aware of what must be done in the coming weeks and months for jk labour registration.

First, you need to be able to put aside your feelings long enough to take an objective assessment of your company's current situation for jk labour registration.

Strategic and Managed Shutdown

Once you've decided to shut down your small business, the real work begins. There are a million little things that need to be taken care of, such as liquidating assets, paying creditors, closing customer accounts, laying off employees, and so on.

Because of the complexity of the process, it is recommended that you consult with legal counsel, an accountant, a broker, or another expert in the field of business and do  jk labour registration.

The SBA's Getting Started page is a good place to start in determining your requirements. Important procedures, such as filing dissolution documents, cancelling registrations, permits, licences, and business names, complying with employment and labour laws, resolving financial obligations, and keeping all the appropriate records, are outlined in detail in the article Steps to Closing a Business.

The IRS website Closing a Business has tools to help you fulfil all tax obligations and avoid costly oversights for jk labour registration.

You can find twenty of the most common business closing forms at the Closing-a-Business-Checklist. If you'd rather not handle these matters on your own, the checklist can serve as a resource for knowing what questions to ask when meeting with your attorney and/or accountant.

If your business is a sole proprietorship or you are the only member of an LLC, you have complete autonomy over when and how to close it also jk labour registration.

However, if you want to include investors or partners, it will have to be a collaborative effort, jk labour registration. First, you should discuss the decision with any investors or partners, and then you should follow the steps for closing the business that you established in any contracts.

Inform Your Employees

When it comes to closing a business, this is where things start to get serious. Quickly communicate the news to your staff; you don't want them hearing it from anyone else, jk labour registration.

If mass layoffs are being considered, the company must ensure it is in compliance with employment and labour laws by providing severance payments to affected workers as required by law, jk labour registration. If you have more than 100 employees, the law requires you to give 60 days' notice before any closures or mass layoffs.

Try To Get Your Hands On Any Past Due Money

It will be very difficult to collect any outstanding payments after you have announced the closure of your business. You'll need the money for things like taxes and legal fees, jk labour registration.

Before making a public announcement of your business's closure, make sure all outstanding accounts are paid in full. One way to do this is to contact the account manager directly or offer a discount for prompt payment.

Notify your clients

Once you've gathered as much money as you can, notify your customers well in advance of the closing so they can start making other plans.

Customers who have grown accustomed to your products or services will likely feel let down when you announce your business's closure. Don't abandon them in the nick of time.

Put Together Dissolution Papers

If your company is an LLC or a corporation, you must file for dissolution in the state in which it was formed in order to be released from liability for taxes and debts incurred by the company.

Some states require you to settle creditor debts before filing for dissolution, while others require you to file for dissolution before you settle creditor debts, jk labour registration. Check the laws in your state and consult a professional if you have any doubts. As a general rule, sole proprietors are exempt from filing any paperwork with the government.

Revoke All Business Permits and Licenses

You must cancel your licence, registration, or permit with the issuing authority. The procedures involved will vary depending on the organisation. This is crucial because if someone else were to start using your company's name or bank account, it could lead to financial trouble and legal trouble.

Make All Due Payments

Pay off any debts you have as you wind down your business. What you owe to lenders and other vendors and service providers is included here. You can try to negotiate with your debtors by contacting them directly, jk labour registration.

When you liquidate your company's assets, you can convert things like computers and customer lists into hard currency that can be put toward paying off your debts.

Evaluate Your Options Regarding Bankruptcy

Ideally, a small business can be shut down without the owner having to file for bankruptcy. To state the obvious, that is not always feasible. Filing for bankruptcy protection is an option you should consider in extreme circumstances.

If you've exhausted all other options and bankruptcy is your only remaining choice, review the IRS's information on filing for bankruptcy at Declaring Bankruptcy, jk labour registration.

You should, as was mentioned, exhaust all other options before filing for bankruptcy. Everything you own, whether it's a customer list, piece of office furniture, website domain, physical location, social media account, or trademark, will have value.

Transfer Property and Finalize Financial Transactions

Once you've settled up with creditors, paid off your taxes and settled any outstanding obligations, you can distribute any remaining assets to yourself (and other partners or owners, if applicable). As soon as that is finalised, you should cut up any company-related credit cards and close the business bank account.

Maintain Proper Files

All financial and personnel records should be kept for at least three to seven years following the closure of a business. Your articles of incorporation, for example, are a legal document that must be kept indefinitely.

The loss probably won't hit home until the last day of business, when you've finished everything and have time to think about your failed small business, jk labour registration.

When something like this occurs, it is expected that you will go through the five stages of grief that everyone goes through: denial and isolation, anger, bargaining, depression, and acceptance.

These grieving processes are usually lengthy and difficult to overcome. However, according to inc.com's The 24-Hour Trick for Getting Over Failure, if you dedicate a full day to dwelling on your setback and allowing yourself to cry, scream, pout, and otherwise wallow in grief and self-pity, you'll be able to move through the stages of mourning and acceptance much more quickly.

Recover and carry on

After getting over the initial shock of your small business failing, you'll be ready to try again. This may take the form of starting a new business, joining an existing one, or even landing a regular job at a regular company.

Restarting after a failed business venture is easier said than done, but it is possible to emerge stronger than you were before, jk labour registration.

With any luck, your next small business venture will be a smashing success, and you won't have to deal with the emotional and logistical challenges of closing a business ever again. However, if you ever find yourself in such a predicament, it's comforting to know that you're not the first, that you're not alone, and that you can get through it.

Know that there are resources available to help you manage your new venture if you decide to launch one, jk labour registration. Improve your next business venture's cash flow and payment processes with the help of PaySimple's streamlined approach to online payment processing, invoicing, and other financial tasks.

All fees collected in accordance with these regulations shall be deposited into the State Treasury under the appropriate head.

Any update required to be reported to the Inspector per Section 7 must be submitted using Form D

Increased use of technology in business has made some tasks easier, but it has also raised others, such as the need to safeguard sensitive customer data. The essence of an individual's right to privacy is the protection of privately held information. No single, all-encompassing law in India deals with the issues of data protection and privacy.

The Indian Supreme Court has ruled in several landmark cases that Article 21 of the Indian Constitution guarantees every citizen the right to life and personal liberty, which includes the right to privacy, jk labour registration.

However, constitutional protections are typically applied only to the State or state-owned organisations, and not to private individuals or private businesses. Torts and contract provisions, such as breach of confidentiality, typically apply to non-governmental violations of the right to privacy.

For payroll purposes, candidate screening, etcEmployers collect SPDI from employees like health records, medical records, financial information, and so on, jk labour registration. When it comes to SPDI, employers have specific duties and risks if they don't meet those duties.

Companies must implement information security practices, standards, programmes, and policies that are proportional to the value of their data in order to comply with the Rules, jk labour registration.

An employer should only collect an employee's SPDI if doing so is required by law, is necessary for the proper operation of the employer, and is in the employee's best interest.

Obtaining such SPDI of its employees would be necessary for the purpose of providing its services if, for example, an airline required medical and fitness records and certifications of their pilots and flight crew, jk labour registration.

Before using the SPDI for any purpose, employers should get employees' signed consent, jk labour registration. Passwords, credit card numbers, medical and biometric records, sexual orientation, etc. are all examples of sensitive personally identifiable information (SPDI) protected by the IT Act.

The employer must take reasonable precautions to inform workers of the collection of their personal data, the data's intended use, the identities of any recipients, and the location of the data collector or data keeper, jk labour registration. The data shouldn't be kept for any longer than is necessary and should be used only for the original intent.

The SPDI must be open to employee review and revision, and the employer must provide the option to withdraw consent at any time. Employers reserve the right to withhold the services or goods for which consent was originally granted, jk labour registration.

Except as required by law or as requested by a governmental agency, an employer must obtain the employee's consent before disclosing any personally identifiable information (unless such disclosure is expressly permitted or required by law).

Nonetheless, such information may be disclosed without further consent to government agencies required by law or any other third party pursuant to a court order, which shall be bound by law not to disclose it further, jk labour registration.

Policy Protecting Individual Privacy

An organisation that processes sensitive employee data must publish a privacy statement in accordance with the Rules.

There are specifics that must be included in a privacy policy, such as the categories of data collected, the rationale behind that data collection, the terms under which it will be disclosed, the security measures in place, etc.

The company's privacy policy must be made available to workers and prominently displayed on the company's website for jk labour registration.

The Rules permit a corporation to disclose sensitive personal information to another corporation anywhere in the world so long as the receiving corporation provides at least the same level of protection for the information as the disclosing corporation, jk labour registration.

If, however, the transfer is required for the execution of a lawful contract between the employer and employee, or if the provider of the information consents to the transfer, then it may be allowed, jk labour registration.

If an employer fails to implement and maintain reasonable security practices and procedures in regard to its employees' SPDI, and as a result, any person suffers wrongful loss or wrongful gain, the employer will be liable to pay damages by way of compensation.

Intentional or negligent disclosure of an individual's personal information obtained under a contract without the consent of the concerned individual or in breach of the concerned contract is punishable by up to three years in prison and/or a fine of up to INR 500,000 (approximately US$ 7,275) under the IT Act. These penalties are in addition to the civil liabilities prescribed under Section 43-A.

The closure notice required by subsection (8) of this section must be submitted to the Inspector in Form E and must be accompanied by the registration certificate for the business being closed.

If an employer sells or transfers his business, he must inform the Inspector of the change within 10 days

Employing Minors: If an Inspector has reasonable cause to believe that an employee is a minor, the Inspector may request that the employer provide appropriate documentation establishing the employee's age.

(i) a verified section of the student's official transcript;

(ii) a Form F medical practitioner's certificate of age.

When an employee is on leave, their employer must keep track of it in what will be called a leave with wages register, and this register must be in Form G format.

When requested by the Inspector, the leave with wages register must be kept for three years after the last entry and presented to him or her, jk labour registration.

Each worker will be given a Form H leave book by their employer. An employee's leave book is his or her property; the employer or his agent has no right to it beyond recording the dates on which leave was taken. The employer or his agent may not keep the book for longer than one week at a time.

Employees are responsible for replacing their own lost leave books, and employers must fill in any blanks using the employee's previous book as a guide.

  • If an employee does not use their accrued casual leave during the calendar year, it will be lost.
  • Employees who have had their requests for leave denied under subsection
  • Specifically, Form Q is to be used for Subsection 26(3).
  • Leave granted with pay must be recorded in the appropriate register and employee leave book.
  • Every employer seeking to pay overtime must first obtain approval from the relevant Inspector at least three days in advance.
  • Form P service cards must be provided to all employees, with a copy sent to the appropriate government inspector.

Establishments engaged in manufacturing shall have the interior walls, ceilings, and tops of all such rooms, whether such walls, ceilings, and tops be plastered or not, as well as all passages and stair cases, lime-washed or color-washed at least once every two years from the time when last lime-washed or color-washed:

The only exception to this is if an Inspector determines that the surfaces have become so dirty that they need lime-washing or color-washing sooner than two years.

Except for floors, all exposed woodwork, such as beams, rafters, doors, window frames, etc., must be painted or varnished once every seven years from the date of the last such treatment, jk labour registration.

Dates of lime-washing, color-washing, painting, or varnishing must be recorded in a Form I log that can be presented to the Inspector at any time.

Moreover, the exceptions listed below mean that the rule in question won't apply to the following:

(i) places where goods are stored exclusively;

(ii) galvanised iron, tiles, asbestos, sheets of similar material, or glazed bricks used for the walls or ceilings of a building.

No accumulation or storage of garbage, filth, or debris shall be permitted on the premises in such a way that effluvia therefrom could enter the building.

Every building used in the production of goods must have fire protection systems in place that allow for safe evacuation in the event of a blaze, jk labour registration.

When people are working in a factory, exit doors must be unlocked and unfastened so that workers can leave the space quickly and safely at any time.

According to the type of business and the size of the building, the appropriate number of and placement of fire buckets and chemical extinguishers is required in every such establishment, jk labour registration.

How is the government helping businesses?

Across the country of India, the startup movement is gaining significant traction. Startup India was launched and is being actively promoted by the government under the leadership of Prime Minister Narendra Modi.

The goal of Startup India is to create an environment where new businesses can thrive. Its ultimate goal is to aid young companies in expanding their operations by means of cutting-edge innovation and computing, jk labour registration.

Many incentives are provided to startup founders in India in an effort to foster economic development. The startups that receive funding through the Startup India programme receive extensive support as they launch their businesses in India, jk labour registration.

Businesses that take the initiative to learn about and adhere to federal agencies and regulatory acts reduce their vulnerability to penalties. Accordingly, companies would do well to foster cordial relationships with regulatory bodies at all levels of government.

Competitive practices, industry-specific activities, Internet activities, general issues of concern, and monetary regulations are all areas where businesses face government oversight, jk labour registration.

All relevant statutes and policies for regulating industries fall under this heading of jk labour registration. On the one hand, government budgetary and monetary policies exert substantial indirect influence over the operation of private sector businesses, jk labour registration.

There is a countervailing trend toward an increase in government's use of direct administrative or physical controls to ensure that private sector investment and production in industry, as well as the allocation of limited resources, are in line with the government's fundamental socioeconomic goals.

Providing financial backing, offering various incentives, and building infrastructure are all examples of the government's promotional role in relation to industries, jk labour registration.

Our government, for instance, has designated certain economically depressed areas as No Industry Districts. To encourage development in economically depressed areas, the government offers tax breaks and other incentives to businesses.

By facilitating a more equitable distribution of resources, the federal government can help eliminate regional disparities. The government is providing aid to small businesses so that they can grow, jk labour registration.

In order to foster the growth of local enterprises, the District Industrial Centers provide resources and guidance. Through the development banks, the government is actively supporting the industrialization of the country.

The government's role as an entrepreneur is evidenced by the public sector's remarkable growth in India from a humble beginning.

Due to the lower returns on investment, private investors are not interested in creating products for general public consumption or social services. However, the government eagerly embraces social entrepreneurs like them, jk labour registration.

As a planner, the government communicates its priorities through the Five Year Plans and the allocation of resources across different industries. Democracy is the backbone of mixed economies.

In an effort to keep things running smoothly, the government engages in economic planning. In today's advanced mixed economy, planning plays a pivotal role. There are three main philosophical traditions from which the concept of economic planning emerged: rationalism, socialism, and nationalism.

Economists support a centrally regulated economy on the grounds that it is more likely to be rational and make the best use of all of the country's resources.

The role of government in business

Setting Policy and Enforcing It

The government of any nation is primarily responsible for making and upholding the law. This is due to the fact that businesses can operate more efficiently when governed by law. In addition, the government offers a judicial system to settle disputes between private parties and the government itself.

Money Supply System

Businesses require a stable monetary system that can only be provided by the government. In addition, it is the government's duty to control inflation, manage the money supply, and defend the dollar's purchasing power against depreciation, jk labour registration.

Facilitating the Establishment with necessary things

In order for businesses to function efficiently, essential infrastructure must be made available by the government. This includes things like roads, electricity, money, workers, and public services.

Information Availability

Governments have a duty to supply information helpful to businessmen so that they can go about their daily work. Governmental agencies publish and distribute a wealth of information that is heavily utilised by commercial enterprises, jk labour registration.

Typically, this data relates to economic and business activity, specific business lines, scientific and technological developments, and other topics of interest to corporations and their top executives.

Technology Exchange

If the findings of publicly funded research institutions are to be used in private industry for mass production, the government must make those findings available to those industries.

Aid for the SME Sector

In order to help small-scale industries flourish, the government must provide the necessary infrastructure and actively promote their growth.

Perform Inspections

The government has an obligation to monitor private businesses to ensure that they are not only producing high-quality goods, but also avoiding the manufacture and distribution of substandard items.

Incentives to Home Industries

It is the responsibility of the Government to encourage the development of home industries by providing them various incentives and subsidies.

For everyone's protection, all potentially hazardous components of machinery must be enclosed by sturdy barriers.

Every facility using electricity in the production process must have in place and maintain appropriate devices to immediately shut off power to any and all operational machinery. No employee with loose clothes on shall be allowed or made to work near the moving machinery or belt.

The employer of every establishment where smoke is produced in the course of carrying out its business, will take effective measures to exhaust out the smoke in order to safeguard the health of the persons employed in the premises.

Businesses selling food and drinks

Every business that serves food or drink to customers is required by law to have an annual medical examination conducted by a licensed doctor for all employees for jk labour registration.

A certificate in Form I to the effect that the person so examined is free from communicable diseases shall be obtained from a registered medical practitioner. This certificate must be shown to the Inspector whenever he or she requests it, jk labour registration.

If an employee changes employers within a year of his last medical exam, he does not need a new medical certificate; instead, a copy of the original certificate will suffice.

Authority and responsibilities of the Inspector An Inspector, in the course of an examination conducted under Section 35, shall, among other things, ascertain the following facts in order to satisfy himself that the provisions of the Act and these Rules and any orders passed thereunder are being duly observed.

(i) that the businesses have proper registrations under the Act;

(ii) all registers, records, and notices required to be kept or posted in accordance with the Act or these regulations have been kept or posted as required;

(iii) that the maximum number of hours worked in a week and the maximum number of days worked in a week are not exceeded, as required by the Act;

(iv) that the provisions of the Act and any orders issued thereunder regarding the opening and closing hours are duly observed,

(v) that the leave provisions of the Act and these rules are followed, and

(vi) that the overtime payment provisions of the Act and these rules are followed.

(vii) that cleaning, sanitation, and fire safety measures are followed as outlined in the Act and these rules, and

(viii) may arrange for a photograph to be taken of any worker or the business's premises.

The inspector must make two copies of the Form K inspection note; one copy is given to the business being inspected, and the other is kept in the inspection notebook in consecutive serial order.

The original copy of the inspection note so recorded will be pasted into a blank register that will be kept in a bound visit book by the employer, jk labour registration. The Inspector may request to see the inspection log at any time to verify that instructions issued during previous inspections have been followed.

Registers and records to be kept and posted in accordance with Section 47: Each employer shall keep a register of employees in Form L showing attendance, overtime worked, and account of wages in respect of each employee under him.

What exactly is the definition of a record?

Any paper created or received in an office is considered a record if it helps the company function. Information created, produced, executed, or received in connection with transactional office activities and either permanently or temporarily preserved as a record (according to a predetermined retention schedule).

There is great administrative, historical, and legal value in records because they are the documented proof of an organization's one-of-a-kind policies, procedures, and decisions.

What are the benefits of good record keeping?

An integral part of records management is the control it provides over information at every stage of its lifecycle (from creation to final disposal, regardless of the medium in which it was originally stored).

Therefore, records management is crucial because it oversees records throughout their lifecycle, ensuring that retention policies are followed, jk labour registration.

Records management is the most reliable method for ensuring that documents with historical, financial, and legal significance are properly identified and preserved, while unnecessary documents are destroyed on a regular basis, per established standards.

The value of organised record-keeping

There are many ways in which a well-implemented records management system can help your business. Below are just a few of the many advantages your organisation will reap from implementing a records management system.

Enhanced conformity

A reliable record management system is essential for businesses in this era of increasingly stringent record compliance regulations.

The HITECH Act, the Federal Agency Improvement and Modernization Act (HIPAA), and other similar statutes and regulations necessitate a methodical strategy for records management. And considering the severity of the consequences for noncompliance, easier, more seamless compliance is incredibly helpful to your agency as a whole.

You should use records management software in conjunction with a reliable records retention policy to ensure regulatory compliance.

Productivity enhancements

It is difficult to know how much time is wasted in the process of storing and searching for records because most agencies don't analyse this data. Yet, it's undeniable that a lot of time is wasted when documents are kept on-site in overflowing file cabinets, jk labour registration.

Even after records have been retrieved, they will need to be refiled, which consumes time that could be put to better use elsewhere.

Important information and data can be quickly retrieved at any time thanks to a centralised, all-encompassing records management system. As a result, your organisation will be better able to handle business efficiently and provide timely service to its constituents thanks to improved workflows.

Think about how many emails and reports your company sends out every day; out of all of that data, only a fraction may be actionable (or that needs to be kept on file). Managing records, especially the paper kind, also requires a significant investment of time and resources, with the need to either find a suitable filing location or print and file every single document.

Good records management, however, will allow your organisation to slow the accumulation of unnecessary paperwork and focus on preserving the information that is truly important to its mission, jk labour registration.

You can save a lot of money with digital records management because it cuts down on storage costs and boosts productivity.

Retrieval Efficiency

Put another way, data is only useful if it can be retrieved; if you can't get to your files when you need them, there's not much point in keeping them. However, with efficient retrieval and easily accessible systems, your organisation can make well-considered decisions quickly.

In addition to simplifying document retrieval, records management software can delete irrelevant information, freeing up space for more valuable assets, jk labour registration.

Additionally, a cloud-based records management system allows for off-site data sharing and updates in addition to on-site. Managers and heads of departments benefit greatly from this level of retrieval capability because they can always find the data they need, resulting in better, more calculated results.

Reduce potential dangers as much as possible.

Your organisation can significantly lessen the likelihood of legal action and related fines by instituting a records management system, jk labour registration.

That's because it's possible to lessen risks when disposing of documents by employing a well-thought-out records management strategy (meaning it dramatically reduces the risk of fines or other disciplinary actions). In fact, effective recordkeeping serves a similar function to that of hiring a lawyer or purchasing insurance against the possibility of loss.

Records can and should be destroyed after a certain number of years, depending on the file type, but there is just as much (if not more) risk in storing them for too long, so it's important to know when to get rid of them, jk labour registration. The failure to delete files after the specified retention period ends can be used as evidence in a lawsuit.

Safeguard information

One of the primary concerns of organisations worldwide is data security (as it should be). No matter how big or small an organisation is, it needs smart software to safeguard its employee records and other sensitive data from the possibility of loss or theft, jk labour registration.

The best records management software will scan all of your incoming paper documents (like letters, invoices, and client contracts) and store them digitally in a searchable archive. In conjunction with a reliable IT system, your data will be safe and easily accessible whenever it's needed.

This is how records management protects your company's sensitive information and ensures that only authorised individuals have access to employee files, jk labour registration.

Keep information safe

The records of a company or other organisation constitute a treasure trove of information that can be used for making decisions and plans in the future.

Each and every document that is created during a working day may be referred to or used in the making of important choices, revisions to policy, etc, jk labour registration. Records are an excellent way to verify or verify information about a team member, as they document regular business operations.

This knowledge retention is critical to the long-term health of your organisation and the immediate enhancement of departmental efficiency, jk labour registration.

Lift spirits

It's undeniable that a less-than-ideal office environment can have a direct impact on employees' morale or motivation, and that poorly managed records, disorganised filing systems, and frequent document loss all contribute to this, jk labour registration.

It may be hard to put a number on how much these setbacks have affected your team, but make no mistake: they have been felt. When you have a reliable records-keeping system in place, you and your employees will have more faith that everything is proceeding as planned.

Every business must post a Form M notice informing workers of the holiday or holidays they can expect pay. A notice outlining the workday's schedule, including breaks for lunch and rest, must be posted in the workplace, jk labour registration.

This notification must be submitted using Form N. Once every three months, with the Inspector's written approval, working hours can be adjusted.

Each business owner is responsible for posting a Form O in a highly visible location to inform their employees of the day(s) of the week that their establishment will be closed. It is prohibited for an employer to change such a day more than once every three months without the prior written permission of the relevant Inspector.

Every business must record workers' attendance using the English Era system. Each business owner is responsible for having all relevant registers and records duly filled out, signed, and dated by the relevant Inspector, jk labour registration.

A notice required to be exhibited under these rules must be displayed in a way that allows anyone it affects to see and read it easily, and it must be renewed whenever it becomes illegible by paying the fee specified in subrule 1 of rule 3.

Any entries that pertain to a given day must be made in a register or record that the employer is required to keep by these rules on the day in question. All relevant registers, records, and notices for a given calendar year must be kept for a further three years, jk labour registration.

The use of either the English alphabet or the Urdu script is required for all registers, records, muster rolls, and notices kept, displayed, or distributed in accordance with this regulation, jk labour registration.

Each business must keep a register into which the Inspector's notices delivered per Rule 19 are entered in chronological order, along with the original receipts, jk labour registration. These must be presented to the Inspector whenever they are requested.

Any request for an exemption under Section 5 must be received by the Government at least one month prior to the beginning of the period for which the exemption is being requested.
