Understanding Karnataka Factory Rules, 1969

The Factories Act is social legislation that is required for the safety, health, and welfare of workers at the workplace. The act applies to all the factories including State and Central government with the following conditions:

  • 10 or more workers are employed with the use of power
  • 20 or more workers are employed without the use of power
  • Less than 10 workers, if an activity is notified by the State government

The objective of the Factory Act

The aim of the Factory Act is to consolidate and amend the law that regulates labour in factories. The Karnataka state has formulated its rules and contemplated under the Act, which is known as Factories Rules, 1969.

Who is required to file Form 21 half-yearly return?

The managers of all the registered factories are required to submit half-yearly returns, twice a year in the prescribed format to the inspector. The half-yearly return has to be submitted in duplicate before the due date.

Is there any penalty for not filing Form 21?

Yes, any person who violates any provisions of the Act or the rules, has to submit a fine which may extend up to 1,00,000 rupees or imprisonment up to 2 years or both.

Registration And Licencing of Factory

You need to apply for registration and grant of licence 15 days prior to starting your manufacturing activity in the factory to the concerned area inspector with the following documents:

1. Registration application in Form No.2 should be duly filled with all particulars and signed by the occupier and the manager. (In Triplicate)

2. List of directors /partners with the memorandum of the article of association /partnership deed (in Duplicate)

3. Prescribed Fee paid according to Table A & B of the Fee Chart and treasury receipted challan for having paid the required registration fee.

4. Health and Safety policy of the proposed factory drawn and duly signed by the occupier in case of factories engaged in the dangerous processes as mentioned in the First Schedule of the Act.

Application submitted with the above-mentioned documents will be evaluated by visiting the factory and the licence will be granted after due verification within 30 days.

Once the application is provided for registration to the department and if no order is communicated to the applicant within three months, then the registration applied for in the said application will be granted.

Existing factories that cater to the applicability criteria mentioned above, will have to submit an application for plan approval and registration along with the above-mentioned documents at once.

Working in a factory without registration and without holding a valid licence can lead to penalties according to the Factories Act.

All correspondence with regards to registration of and grant of licence shall be made either to the concerned area Inspectors or to the Chief Inspector of Factories and Boilers whose addresses are available on the official government website.

Renewal of Factory Licence

The licence needs to be renewed every year and the documents to be submitted for renewal are as follows:

  • Application in Form No.2 in triplicate;
  • Original Licence;
  • Treasury receipted challan or cheque or D.D (drawn in favour of " The Chief Inspector of Factories and Boilers, Bangalore".
  • List of directors/partners with addresses in triplicate;

Applicants can also avail of the benefit of the renewal of the factory licence for 3 years at once. For this, they are required to pay three years licence fee along with the above-mentioned documents.

The documents pertaining to the renewal of the factory licence have to be submitted to the office of the jurisdictional Inspector on or before 31st October i.e., two months before the expiry of the licence issued.

In case any application is submitted after the mentioned due date, he will be liable to pay a surcharge of 25% of the licence fee. To avoid this, the application needs to be submitted in time.
