Form 13 Register of Adult Workers, also known as Leave Form 13, is part of the West Bengal Factories Rules, 1958. The West Bengal Factories Rules, 1958 specifies the rules to be followed by factories registered in the Indian State of West Bengal. The rules apply to all factories and companies employing more than ten (10) workers with the use of power and more than twenty (20) workers without the use of power. What is the Leave Form 13?

Leave Form 13 is part of the West Bengal Factories Rules, 1958. According to the Factories Rules, all employers/ factories must maintain a record of the Leave Form 13 and present it to the Inspector (an officer appointed under sub-section (I) of section 8 of the West Bengal Factories Rules, 1958) as and when required.

According to Section 83 of the West Bengal Factories Rules, 1958, Form 13 Register of Adult Workers or Leave Form 13 must be neatly filled. The following provisions apply for filling the Leave Form 13:

  • The details of workers classified under Section 61 must be entered in a specific part of the Leave Form 13
  • When an employer transfers an employee or worker from one Relay or Group to another, the employer must enter information about the Group from which they have been transferred and the Group to which they have been transferred against the employee’s name in the Leave Form 13. The information must include information about the actual date and time of finishing work in one Group or Relay and the actual date and time of commencing work in the other Group or Relay
  • When a worker leaves a factory or is terminated from work, the Factory, Human Resource, or Personnel Manager must mention the date of the employee’s leaving or termination in the ‘Remarks’ column in Leave Form 13
  • All Factory, Human Resource, or Personnel Managers must fill Leave Form 13 using ink. Moreover, it must be legible and up-to-date
  • All Factory, Human Resource, or Personnel Managers must maintain the Leave Form 13 register in English, and the dates entered must be according to the English calendar
  • All Factory, Human Resource, or Personnel Managers must maintain the Leave Form 13 for three consecutive calendar years from the year of filing the form. Also, it must be kept in the factory for examination and inspection by the Inspector whenever required

Which Compliance Forms Do A Factory Manager Needs to Submit?

The West Bengal Factories Rules, 1958, of which the Leave Form 13 is a part, specifies the compliance forms all registered employers must fill and submit to the concerned authorities. Besides Form 13 Register of Adult Workers or Leave Form 13, a Factory, Human Resource, or Personnel Manager must submit the following compliance forms:

  • Form 1 - Application for permission to construct, extend, or take into use any building as a factory
  • Form 2 - Application for registration and grant or renewal of licence and notice of occupation specified
  • Form 3 - Licence to work in a factory
  • Form 4 - Certificate of fitness
  • Form 5 - Humidity Register
  • Form 6 - Register of lime washing, painting, etc.

Form 13 Register of Adult Workers - Ways to Fill the Form Correctly

The following subsections deal with the provisions of the Form 13 Register of Adult Workers or Leave Form 13 to help you fill the form correctly:

For the month of _______ and For the period of ______

In this section of the Leave Form 13, you need to specify the month and the period for which you are entering the information.

Serial No.

Specify the serial number of the employees in this subsection of the Leave Form 13.

Name

Mention the name of the employees according to the serial number in this subsection of the Leave Form 13.

Nature of Work

In this subsection of the Leave Form 13, the manager must disclose the nature of the work of the employees. The nature of work must be in accordance with the guidelines laid in the Factories Act 1948.

Group No.

In this subsection of the Leave Form 13, the Factory, Human Resource, or Personnel Manager needs to mention the Group No. of the concerned employee. According to the Factories Act 1948, Group refers to the sets of workers working as part of two sets doing the same work in different periods or shifts.

Relay No.

In this subsection of the Leave Form 13, the Factory, Human Resource, or Personnel Manager needs to mention the Relay No. of the concerned employee. According to the Factories Act 1948, Relay refers to the sets of workers working as part of two sets doing the same work in different periods or shifts.

Particulars of transfer from one Group or Relay to another

In this subsection of the Leave Form 13, the Factory, Human Resource, or Personnel Manager needs to mention the details of the transfer of an employee from one Group or Relay to another group or Relay.

No. and date of Certificate if an adolescent

According to Section 68 of the Factories Act 1948, any employer employing adolescents above the age of fourteen (14) must possess a Certificate of Fitness with reference to the adolescent employee under Section 69 of the Act. Moreover, the adolescent employee must carry a Token No. assigned to him or her, giving reference to the Certificate. In this subsection of the Leave Form 13, the Factory, Human Resource, or Personnel Manager must mention the No. of the Certificate and date and the Token No. giving reference to the Certificate.

Number of hours worked each day

In this subsection of the Leave Form 13, the Factory, Human Resource, or Personnel Manager must mention the number of hours each employee has worked each day during the period or month mentioned in the Leave Form 13. According to Section 54 of the Factories Act 1948, employers cannot ask employees to work for more than nine (9) hours a day without paying overtime.

Remarks

When a worker leaves a factory or is terminated from work, the Factory, Human Resource, or Personnel Manager must mention the date of the employee’s leaving or termination in the ‘Remarks’ column in Leave Form 13
